NBP inmate claims he stabbed Sebastian to prevent testimony vs. De Lima
An inmate in the New Bilibid Prison's (NBP) Building 14 had claimed that high-profile Bilibid inmate Jaybee Sebastian was attacked allegedly to prevent him from testifying against Sen. Leila de Lima.
NBP inmate Tomas Doniña, who was the one who stabbed Sebastian, made the claim in his affidavit that was read by an investigator of the Criminal Investigation and Detection Group during an inquiry of the House of Representatives justice committee on Wednesday.
"Sa sinumpaang salsaysay ni Tomas Doniña na ibingay n'ya noong ika-8 ng Oktubre 2016... ay inilahad n'ya na noong September 28, 2016 bandang 7:45 ng umaga ay pinagtangkaan niyang patayin si Jaybee," said Ebreo, reading from Doniña's affidavit.
Doniña claimed he attacked Sebastian upon instructions from a former colleague at the Philippine Navy.
"Sa kadahilananng may kumausap sa kanya na isang dati niyang kasamahan sa Philippine Navy na dapat ay gawan niya ng paraan para mapatahimik at mapatay si Jaybee Sebastian para hindi siya makapagsalita laban kay Ma'am Leila de Lima ukol sa paglaganap ng droga sa NBP," read Doniña's affidavit.
A number of Bilibid inmates earlier testified in a separate investigation by the House justice committee that Sebastian had collected drug money from them supposedly to be used for De Lima's senatorial campaign.
De Lima had repeatedly denied the accusations, saying she was never involved in the illegal drug trade inside the national penitentiary.
De Lima claimed Sebastian was a government asset helping authorities to combat the illegal drug trade. Sebastian denied De Lima's claim.
Wounded along with Sebastian during the September stabbing incident were fellow inmates Vicenty Sy and Peter Co. A fourth inmate, Tony Co, was killed during the attacks.
Doniña attacked Sebastian inside Building 14's mess hall. Another inmate, Clarence Dongail killed Co in another attack inside the Chinese inmate's cell.
Earlier this month, Sebastian filed graft and criminal charges against De Lima and former prison officials.
Issues mentioned in the complaint sheet against De Lima include:
the alleged complicity of De Lima, former Justice Secretary, in the proliferation of illegal drug trade in the New Bilibid Prison (NBP) in exchange for campaign funds
De Lima's claim that Sebastian was a government asset inside the national penitentiary
Sebastian's transfer from the maximum security compound to Building 14 despite threats to his life
De Lima was charged with violation of Section 3 of the Anti Graft and Corrupt Practices Act (Republic Act 3019; Section 5 of the Code of Conduct and Ethical Standards for Public Officials and Employees (Republic Act 6713); the Anti Torture Act (Republic Act 9745); An Act Punishing the Receiving and Giving of Gifts of Public Officials and Employees (Presidential Decree 46) and indirect bribery.
Also charged were former Bureau of Corrections chief Ricardo Rainier Cruz and former NBP head Richard Schwarzkopf Jr.
Cruz and Schwarzkopf, however, were not included in the complaints for indirect bribery and violation of PD 46.
